make up pools
make up pools are used by the carrier when an established pool has no pools available or as extra freight service. in application of blet agreement, article 4, § 10 the make up engineer is to be deadheaded back to the home terminal unless, within 16 hours, there is a reasonable probability of a place where he can be worked back to his home terminal.
besides collective bargaining support there is also a board award support. public law board 2995, award 40 directly addresses the carrier failing to deadhead engineers after 16 hours at the away from home terminal:
"the board can appreciate the fact that the carrier does not have a 'crystal ball' to determine the parameters of its operations. however, we do not find that such a ball was needed for the carrier to have determined that it would not be able to show reasonable probability of a place where it could work the claimant back to his home terminal within the 16 hours set forth in the (agreement)..."
submit the penalty (pe) claim as follows:
"allow 8:00 penalty at engineer through freight rates (class 25) for representing a make up pool and not being deadheaded back to the home terminal after 16 hours. claimant was representing pool bbmu and performed road relief on train 13th736 from elmira, ny (hb/st mpsr 273) to binghamton, ny (hb/st mpsr 214). upon arrival at the away from home terminal of binghamton, claimant was put into the hotel for 19 hours and 30 minutes before being deadheaded back to the home terminal. reference public law board 2995, award 40.
